Acceptance of Terms of Use
By making payment for, or participating in, this activity, you confirm that you have read and accepted these Terms of Use.
Organiser
This activity is organised and operated by Have A Dig Pty Ltd (Organiser).
Eligibility and Supervision
Participation is open to individuals aged 5 years and over. Participants aged 12 years or under must be accompanied and supervised at all times by a parent or legal guardian. The accompanying parent or legal guardian is responsible for the child’s supervision, conduct, and safety for the duration of the activity. The Organiser may refuse, suspend, or end a person’s participation if the person does not meet safety, eligibility, or behavioral requirements.
Participant Conduct, Responsibilities, and Health & Safety
All participants must follow staff instructions at all times and operate remote-controlled vehicles only within the designated area. Equipment must be used responsibly and returned promptly after use. Participants are expected to behave in a safe and respectful manner, including not running, pushing, obstructing walkways, or interfering with other participants or vehicles, entering restricted areas, climbing on equipment, or engaging in unsafe behaviour. Participants must ensure that they are physically capable of taking part. If you feel unsafe or observe unsafe behaviour, notify staff immediately. The Organiser may remove any participant from the activity if they fail to comply with these requirements or if their behaviour poses a risk to themselves, others, property, or equipment.
Assumption of Risk
Participation is voluntary and involves inherent risks, including the possibility that remote-controlled vehicle may move unpredictably and cause minor collisions. By participating, you acknowledge and accept these inherent risks.
Equipment Use and Responsibility
All equipment remains the property of the Organiser and must be used only as directed. Participants are responsible for returning equipment in good condition. If equipment is damaged because of misuse, careless behaviour, or failure to follow instructions, the Organiser may require the responsible participant, or the parent or legal guardian of a child participant, to pay the reasonable cost of repair or replacement.
Emergency Medical Authorisation and Consent
If a participant is injured or requires urgent assistance, the Organiser may provide or arrange first aid or emergency assistance as reasonably necessary. By participating, you consent to the Organiser arranging such assistance if needed. Any ambulance, medical, or related emergency response costs remain the responsibility of the participant, or the parent or legal guardian of a child participant, except to the extent the law provides otherwise.
Liability and Australian Consumer Law
Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, right, or remedy available under Australian Consumer Law that cannot be excluded by law. To the extent permitted by law, the Organiser and its staff are not liable for loss or damage to personal belongings, minor incidental collision, delays, or interruptions occurring during normal participation, or indirect or consequential loss. Where the Organiser is legally entitled to limit its liability, that liability is limited to the maximum extent permitted by law.
Queuing and Time Limits
Participation may be subject to queueing or wait times during busy periods.
Media and Photography
This activity takes place in a public environment where photography and filming may occur. The Organiser may take photographs or video recordings for promotional purposes unless you notify the Organiser in writing before participating that you wish to opt out. Members of the public may also take photographs or recordings in public areas, and the Organiser is not responsible for that activity.
Personal Information
Any personal information collected for participation, safety, or incident management purposes will be handled in accordance with the Organiser’s Privacy Policy and used only for activity-related purposes. The Privacy Policy is available at: www.haveadig.com.au
